Clarification from the Ministry of Trade and Industry about the working hours for businesses

The Retail Association, after successive requests for the final decision of the Government to be interpreted correctly and to allow the operation of grocery stores despite the time limit as it is clearly written in the decision, is pleased to share with you this clarification issued by the Ministry of Trade and Industry.

The Ministry of Trade and Industry (MTI) explains to businesses and bodies responsible for overseeing the implementation of laws and decisions of the Government, that based on the Decision of the Government of the Republic of Kosovo, no. 01/42 dated 11/11/2020, markets are allowed to operate regardless of the categorization of municipalities according to the level of risk of infection.
The Ministry of Trade and Industry, respectively the Market Inspectorate clarifies that with the Decision of the Government of the Republic of Kosovo no.01 / 42 on general and specific measures for protection from the COVID-19 pandemic, respectively in point 20, 20.8 of this decision is defined allowing the exercise of activities, regardless of the categorization of municipalities according to the level of risk. In the list of allowing the exercise of activities is also the food products sector respectively markets.
Whereas in points 23, 24 and 25 of the same decision are defined the measures that are valid for the municipalities with low, medium and high risk of infection, where it is determined that the economic operators are allowed to work from 05 to 18:00. and in this case it is about economic operators that exercise other activities, excluding the list of activities that are allowed to operate according to point 20 of this decision, who are allowed to work according to regular hours and regardless of categorization according to the level of risk.
The legal office of the Market Inspectorate at MTI explains that during the consultation with the inspector in question, he tried to advise the inspectors according to the above explanation.
We think that the decisions of the Government of the Republic of Kosovo should be read correctly and implemented in this form, by the bodies responsible for the implementation of laws and decisions of the Government, as otherwise we may face legal consequences, as well as actions. unfair administrative, we can undoubtedly create economic losses for economic operators who are thus hit by the Covid-19 pandemic.
In this case, economic operators are invited to file a complaint to the MTI Market Inspectorate against any administrative action taken by market inspectors, which are considered contrary to applicable laws and decisions.
